Terms of Service
Last updated · 8 Oct 2026
These terms are the agreement between you and CapQA for using capqa.app, the free check, Studio and client review links. Together with the Privacy policy, the Cookie policy and the Refund policy, they are what you agree to when you create an account or buy a plan. You can read, save and print them here at any time, free of charge.
These terms are also available in Polish (Regulamin). Both versions say the same. For consumers and sole traders with consumer protection who live in Poland, the Polish version prevails.
Who we are
CapQA is run by Antoni Nasiadko, Poland (“CapQA”, “we”, “us”). Write to hello@capqa.app about anything to do with the service, including complaints, withdrawal and reports of illegal content. The same address is our single point of contact for users and authorities under the EU Digital Services Act; you can write in English or Polish.
Words we use
- Consumer — a person using CapQA for purposes outside their trade, business or profession.
- Sole trader with consumer protection — a person running a sole proprietorship who buys CapQA for a purpose that is not professional for them, judged by their registered business activity. Under Polish law they have the consumer rights described in these terms on withdrawal, conformity and unfair terms.
- Delivery job — one source video taken through QA in Studio to export. Re-burns and re-exports of that video inside the job do not use another job.
- Plan — Free, Creator or Agency, as described on the pricing page. Creator Lifetime is no longer sold; where these terms still mention it, they govern the people who bought it while it was on sale.
The service
CapQA checks where captions and on-screen text land on vertical video, and fixes it:
- The free check opens a video in your browser and draws the interface of TikTok, Instagram Reels and YouTube Shorts over a frame of it. It needs no account and does not upload the video.
- Studio transcribes your video, checks brand terms against your glossary, burns captions and a logo inside the 900×1400 safe zone of a 1080×1920 frame, and stamps each export SAFE or REJECT for the destination you chose.
- Client review links let the people you deliver to approve an export or ask for changes.
- Creator adds the TikTok Ads mask; Agency adds up to 10 brand glossaries and review links on your own domain.
What each plan includes is listed on the pricing page. The free check and the Free plan cost nothing.
What a SAFE stamp means
SAFE means that when you exported, the captions and logo sat inside the safe zone and clear of the interface masks CapQA holds for the destination you chose. The masks follow the platforms’ public layouts and can lag behind a change a platform makes.
CapQA does not promise views, reach, ad performance, approval of an ad by TikTok, Meta or Google, or that a client will accept your work. CapQA is software, not insurance: it does not pay compensation for rejected work or lost fees beyond the liability described under Liability below.
What you need to use it
- A current desktop browser with JavaScript and WebAssembly enabled. Studio encodes video in the browser, so a slow or low-memory device takes longer.
- An internet connection, and an email address or a Google account to sign in.
- Vertical 9:16 video; Studio exports at 1080×1920.
Your account
- You must be 18 or older.
- Use an email address you can receive mail at and keep access to it secure. You are responsible for what happens on your account.
- If you use CapQA for a company, you confirm that you may accept these terms for it.
The agreement for the Free plan starts when you create an account and runs until you or we end it.
Paid plans and payment
- Creator is $15/month or $129 a year; Agency is $39/month or $349 a year. Prices are in US dollars. Starter and Creator Lifetime are no longer available to buy.
- An introductory price, such as the Founding Creator launch rate, applies only to the billing period it names — for Founding Creator, the first month of Creator monthly. After it, the plan renews at the list price above until you cancel. We may end an introductory offer for new subscriptions at any time; ending it does not change a period already paid for.
- Payment is handled by Stripe. Stripe Checkout shows the total before you confirm, and that total is what you are charged.
- The agreement for a paid plan starts when your payment is confirmed. We confirm it by email to your account address.
- Plans are paid in advance and renew from the day you bought them — each month on a monthly plan, each year on a yearly one — until you cancel. Cancel any time from Manage billing in Settings: the plan stays active to the end of the period you paid for and is not charged again.
- Creator and Agency have no delivery job cap. Free includes 3 delivery jobs per calendar month in UTC, and unused jobs do not carry over. Creator Lifetime, where it was bought, keeps the cap it was sold with.
- You can switch between monthly plans from Manage billing, which shows the prorated amount before you confirm.
- If a renewal payment fails and is not settled, the plan ends and the account returns to Free.
- Creator Lifetime was a single payment for the Creator plan for as long as we run CapQA. It is no longer sold. Where it was bought it still applies, cannot be moved to another account and does not include Agency.
Fair use of an unlimited plan
"No job cap" means we do not count your deliveries and do not sell credits. It does not mean unmetered infrastructure. To keep the service up for everyone we apply the same technical rate limits to every account — a ceiling on how many transcriptions can be started in an hour — and we may decline automated or bulk use that is not a person delivering their own work. These limits are set well above normal professional use; if you ever meet one, write to us and we will look at it. We will not close a paid account for reaching a limit without telling you first.
Price changes
We can change the price of a monthly plan when our costs change, when taxes change, or when we change what the plan includes. We tell you by email at least 30 days before the new price applies to you. It applies from your first renewal after that notice, and you can cancel before then. The price of Creator Lifetime does not change once you have paid.
Your right to withdraw
If you are a consumer or a sole trader with consumer protection, you can withdraw from the agreement for a paid plan within 14 days of the day it was made, without giving a reason. Send us a clear statement before the 14 days end — an email to hello@capqa.app, or the withdrawal request in Settings → Billing, is enough; either way we confirm it by email. You may use this model, but you do not have to:
To Antoni Nasiadko, hello@capqa.app: I withdraw from my agreement for the following plan: [plan], bought on [date], account email [email address]. Name: [your name]. Date: [date].
We refund your payment within 14 days of receiving your statement, to the payment method you used, at no cost to you.
Your plan starts as soon as you pay, so at checkout we ask you to request that start, before the 14 days are over; a plan cannot be bought without it. If you then withdraw, you pay for the service provided until you told us: the monthly price of your plan, divided by the days of that month and multiplied by the days you had it. For Creator Lifetime, the calculation uses the monthly price of Creator. We refund the rest. A plan bought without that request, under an earlier version of these terms, is refunded in full. The Refund policy also gives a full refund of Creator Lifetime within 14 days if you have not completed a delivery job.
Complaints
If CapQA does not work as these terms or the pricing page describe, tell us at hello@capqa.app. Include your account email, what went wrong and when, and what you would like us to do. We reply within 14 days of receiving the complaint.
Consumers and sole traders with consumer protection have statutory rights when a digital service does not conform to the agreement: to have it brought into conformity and, if that is impossible, fails or the problem is serious, to a price reduction or to end the agreement with a refund for the affected period. These terms do not limit those rights.
If we cannot settle a complaint, a consumer in Poland can get free help from a municipal or county consumer ombudsman (rzecznik konsumentów) or a consumer organisation, and the Office of Competition and Consumer Protection (UOKiK) lists out-of-court options on its website. Consumers elsewhere in the EU can contact their national European Consumer Centre.
Acceptable use
- Upload and share only footage, music, logos and brand material you have the right to use.
- Nothing unlawful: no content that infringes other people’s rights, is defamatory, sexually exploits minors, incites violence or hatred, or deceives the people you send it to.
- No scraping, reverse engineering or malware, and no attempts to break or overload the service, get around plan limits, or reach other people’s accounts or data.
- No automated or scripted use of Studio. A paid account is for one person or one team unless we agree otherwise.
- Send review links only to people who expect them.
Your content
You keep all rights to your footage, captions and client material. You give us a limited licence to host and process it only to provide the service — transcription, rendering and review links — and for no other purpose. We do not use your video or audio to train AI models. You are responsible for the content you upload and share; we do not check it before it is processed. The Privacy policy explains where content is stored and for how long.
Client review links
When you share a review link, you decide what your client sees. Make sure you are entitled to share that material and your client’s details with us; we handle them on your behalf to run the review.
Reporting illegal content
Review links store content that users upload. If you believe any of it is illegal, email hello@capqa.app with why you believe it is illegal, the exact link to it, your name and email address, and a statement that you believe in good faith that your report is accurate and complete. A report about child sexual abuse material does not need your name or email address.
We confirm that we have received the report, review it without undue delay and tell you what we decided and how you can challenge it. People review reports; we do not use automated tools to decide about content. Where content suggests a crime that threatens someone’s life or safety, we inform the authorities.
If we remove content, disable a review link, or suspend or close an account, we tell the user affected why, what facts we relied on and how to challenge the decision, unless the law or an authority requires us not to. You can reply to ask us to review the decision, and you can always take it to court.
Suspending or ending the agreement
You can end the agreement at any time: cancel a monthly plan from Manage billing in Settings, and email us to delete your account.
We can suspend or end your access if you seriously or repeatedly break these terms — for example by uploading illegal content, attacking the service or not paying. Where the breach can be fixed, we first ask you to fix it and give you reasonable time, unless that would expose other people or the service to harm. Either way we tell you the reasons. If we end a paid plan when you have not broken these terms, we refund the unused part of the period you paid for.
We can also end the Free plan or a monthly plan with at least 30 days’ notice by email if we stop offering that plan or the service, or if the law requires it. If we close CapQA, we tell every paid user by email at least 60 days before it closes.
Changes to the service and to these terms
We change CapQA to improve it, to follow changes platforms make to their interfaces, when the law or security requires it, or when a provider we rely on changes. These changes cost you nothing.
If a change reduces what you can use on a paid plan in more than a minor way, we tell you by email at least 30 days in advance. If you are a consumer or a sole trader with consumer protection, you can then end the agreement within 30 days of the change and get back the part of your payment for the time after it.
We can change these terms for the same reasons, or to cover new features or plans. We email users at least 30 days before a change takes effect and update the date at the top of this page. A change never applies to a period you have already paid for. If you do not accept it, you can end the agreement before it takes effect; if you keep your account after that date, the new terms apply.
Availability
We aim to keep CapQA available at all times, but maintenance, updates and outages at providers we rely on — hosting, payments, transcription — can interrupt it. We keep planned maintenance short.
Platforms and other brands
CapQA is not affiliated with, endorsed by or sponsored by TikTok, Meta, YouTube, CapCut, Submagic or Captions. Their names are trademarks of their owners and appear only to describe compatibility and comparisons.
Our intellectual property
The CapQA name, logo, website and software belong to the operator. Typefaces are used under their licences: Clash Display from Indian Type Foundry under the ITF Free Font License; Fraunces and JetBrains Mono under the SIL Open Font License 1.1, which also covers the Fraunces-based caption face bundled with Studio.
Liability
If you are a consumer or a sole trader with consumer protection, our liability follows the law and nothing in these terms limits it.
If you use CapQA as a business, we are not liable for lost profits, lost client revenue or revision costs, including those caused by changes platforms make to their interfaces, a misunderstood brief or edits made outside Studio, and our total liability is limited to the fees you paid us in the twelve months before the claim. This does not limit liability for damage we cause intentionally, or any other liability the law does not allow to be limited.
We are not responsible for the decisions platforms or clients make about your videos.
Governing law and disputes
These terms are governed by Polish law. If you are a consumer, you keep the protection of the mandatory law of the country where you live and can bring a claim in its courts. Disputes with business customers go to the court with jurisdiction over our place of business.
